Driver Logged In, Ride Accepted or Passenger in Car 

Much greater coverage applies after the driver accepts a passenger’s ride request. From that point until the ride is completed, Illinois law requires $1 million in primary automobile liability insurance.

What if the Uber or Lyft Driver Says I Caused the Accident?

Whether one driver is a rideshare driver doesn’t affect Illinois negligence law. You still need to prove that the other driver was responsible for causing the accident.

Illinois follows a concept called "modified comparative negligence." Under 735 ILCS 5/2-1116, someone can recover compensation when their own share of fault is 50 percent or less. The compensation is reduced according to that percentage. Someone who is more than 50 percent responsible cannot recover anything.

This gives insurance companies a major reason to argue about how an accident happened. After a serious crash, you will almost always need to make a convincing argument that the other driver was at fault using extensive evidence.
